Terms of Service

Who we are and what these terms cover

These terms apply to every order you place with amberdesigner, Vītolu iela 4, Bauska, Bauskas novads, LV-3901, Latvia (email support@amberdesigner.com, phone +371 6392 7391), and to your use of this website. When we write “we”, we mean amberdesigner. When we write “you”, we mean the person or business placing the order. If you are a consumer, nothing in these terms limits the rights you have by law.

Packages and scope

Each package on this site states its scope: what is included, the number of pages, products or screens, languages, revision rounds and a typical timeline. The scope we confirm in writing when you order is the scope of the project. Anything outside it is extra work.

Ordering

You order by adding a package to the cart and completing checkout, or by accepting a proposal we send after a brief. The contract is formed when we confirm your order by email. We may decline an order, for example if we cannot deliver the scope in a sensible timeframe, and if so we tell you promptly and refund anything you have paid.

Prices and VAT

Prices on the site are in euros and exclude VAT. VAT at the applicable rate, currently 21% in Latvia, is added at checkout and shown on the invoice. If you are a business in another EU country and give us a valid VAT number, we confirm on the invoice whether reverse charge applies. We fix the price of a package at the time you order.

Payment

For one-off packages, you pay a 50% deposit when you order and the remaining 50% when you approve the launch. We invoice each part, and you pay by the due date on the invoice. We publish the finished site, or hand over the final files, once the balance is paid. For care plans, we bill each month. The online checkout may run in test mode, in which case it shows a notice and no payment is taken; we then confirm your order by email and send an invoice for the deposit.

What we need from you

You provide the content, images, access and decisions we need, on time. You confirm that you have the right to use everything you give us and that it does not infringe anyone’s rights. Timelines assume that feedback arrives within a few days of each request. If you are slow to respond, the schedule moves with you.

Revisions and extra work

Each package includes a stated number of revision rounds. A revision round is one consolidated set of feedback on the current stage. Additional rounds, and work outside the agreed scope, are quoted first and carried out only after you approve the price in writing.

Acceptance and launch

When the work matches the agreed scope, we ask you to approve the launch by email. After you approve it and pay the balance, we publish the site or hand over the files and access. If something does not match the agreed scope, tell us and we will correct it.

Ownership and licences

Once you have paid in full, you own the final deliverables we made for you, such as the designs, logos and site files. This does not include: third-party material such as fonts, stock images, software libraries and platform themes, which stay under their own licences; and tools, code and methods that we use across projects and that existed before your project. You have the right to use them as part of your deliverables. Unless you ask us in writing before launch not to, we may show the finished work in our portfolio and describe it in general terms. Our concept projects are fictional and are not client work.

Hosting, domains and third-party platforms

Hosting, domain names, platform subscriptions (such as Shopify), payment processor fees and third-party licences are not included in our prices unless the package says so. They are billed by their providers under their own terms. We are not responsible for outages or changes at those providers.

Care plans

Care plans are billed monthly and continue until you cancel. You can cancel at any time with 30 days’ notice by email. The current month is not refunded. Included hours cover content and design changes that fit within them; larger changes are quoted first.

SEO and performance work

We fix technical issues and measure the results. We do not promise any search ranking, traffic level or sales result, because search engines and markets are outside our control.

Cancellation and refunds

Cancellation and refund rules, including the 14-day right of withdrawal for consumers, are in our Refund & Cancellation policy, which forms part of these terms.

Liability

Nothing in these terms excludes or limits liability that cannot be excluded or limited by law, including liability for intent or gross negligence. Subject to that, our total liability to you for any claim connected to a project is limited to the fees you paid for that project, and we are not liable for indirect or consequential loss, such as lost profit or lost business. We are not liable for delays or failures caused by events outside our reasonable control.

Confidentiality

We treat the non-public information you give us as confidential and use it only to carry out your project.

Using this website

You may browse and use this site for lawful purposes. Please do not attempt to disrupt it or access it without authorisation. The design, text and graphics of the site belong to amberdesigner and may not be copied without permission.

Complaints and disputes

If something goes wrong, write to support@amberdesigner.com and we will try to resolve it quickly. If you are a consumer, you can also contact the Consumer Rights Protection Centre of Latvia (Patērētāju tiesību aizsardzības centrs) at ptac.gov.lv, or an out-of-court dispute resolution body.

Governing law

These terms are governed by the laws of the Republic of Latvia. The courts of Latvia have jurisdiction, except that if you are a consumer you keep the protection of the mandatory law of the country where you live, and you may bring a claim in the courts of that country.

Changes

We may update these terms. The version in force when you order applies to your order.
